Terms of Service Last updated: July 30, 2026 1. About FallWatch Family FallWatch Family is a coordination layer on top of Apple's built-in fall detection. When a monitored person's Apple Watch or iPhone detects a fall, their family members get an alert with the status, the approximate location if enabled, and a shared thread to sort out who is doing what. Apple does the sensing; FallWatch handles the family conversation that follows. FallWatch Family is built by Loud Unicorn LLC. 2. Who Can Use FallWatch Family FallWatch Family is intended for adults aged 18 and older. The person setting up a monitored device, and each family member joining a group, must be at least 18. 3. Permitted Uses - Set up a device as monitored, or join a family group as a responder - Receive alerts when Apple's fall detection reports a fall - Share and update a status after a fall event - View the approximate location of a fall event, if the monitored person enabled location - Coordinate a response with other family members in a shared thread 4. Prohibited Uses - Using the app as a medical alert system, personal emergency response system, or substitute for calling emergency services - Adding a person to a monitored device without their knowledge and consent - Sharing a family code with anyone the monitored person has not agreed to include - Using the app to surveil or track a person's movements - Reverse engineering, decompiling, or tampering with the app - Automating or scripting interactions with the app - Sharing paid features with users who have not purchased them - Using the app in ways that violate Apple's App Store Guidelines 5. Consent of the Monitored Person Do not set up FallWatch Family on another adult's device, or add them to a family group, without telling them and getting their agreement. The monitored person must understand that fall events, statuses, and optionally their location at the time of a fall will be visible to everyone in the family group. They can revoke location access at any time in iOS Settings and can leave the group in the app. Setting this up covertly may be unlawful where you live and is a violation of these Terms. 6. NOT AN EMERGENCY SERVICE — READ THIS FallWatch Family is not a medical device, not a medical alert system, not a personal emergency response system, and not a monitoring service. No person is monitoring the app. We do not contact emergency services, dispatch help, or guarantee that any alert will be delivered. Fall detection is performed by Apple, not by us. Apple's fall detection may fail to detect a fall, may report a fall that did not happen, and depends on the person wearing a supported Apple Watch with the feature enabled. Alert delivery depends on iOS notification delivery, network connectivity, iCloud availability, and every device in the group being signed in and functioning. Any of these can fail without warning. Do not rely on FallWatch Family for the safety of a person at risk. If someone needs help, call your local emergency number. If a person requires reliable monitoring, use a certified medical alert service. To the fullest extent permitted by law, Loud Unicorn LLC disclaims all liability for injury, death, delay in receiving help, or any other harm arising from a missed, delayed, false, or undelivered alert. 7. Family Plan FallWatch Family is free for a single monitored person. An optional auto-renewing subscription adds additional monitored people, response history, and escalation rules. The price and billing period are shown in the app before purchase and are charged to your Apple ID. Auto-Renewal: Subscriptions renew automatically unless cancelled at least 24 hours before the end of the billing period. Your Apple ID account will be charged within 24 hours prior to renewal. Managing Subscriptions: Cancel anytime in iOS Settings > [Your Name] > Subscriptions. Cancelling stops future billing but does not refund the current period. Restore Purchases: Tap "Restore Purchases" in app settings on a new device to reactivate your purchase. Refunds: Handled by Apple. Contact Apple Support. We do not process refunds directly. 8. Apple's Standard EULA In addition to these Terms, your use of FallWatch Family is governed by Apple's Licensed Application End User License Agreement (EULA): https://www.apple.com/legal/internet-services/itunes/dev/stdeula/ 9. User Content You are responsible for the content you add to FallWatch Family. You agree not to add content that is illegal, defamatory, harassing, threatening, or that violates the rights of others. We reserve the right to suspend access if content violates these Terms. 10. Intellectual Property FallWatch Family, including its design, code, graphics, and user interface, is owned by Loud Unicorn LLC and protected by copyright and intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes. 11. Disclaimer of Warranties FallWatch Family is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not warrant that: - Any alert will be generated, delivered, or delivered in time - Apple's fall detection will detect a fall, or will not report a false one - Location information will be accurate or available - CloudKit sync will be instantaneous or available - The app will keep anyone safe - The app is free from bugs or errors 12. Limitation of Liability To the maximum extent permitted by applicable law, Loud Unicorn LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of FallWatch Family. Our total aggregate liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $10 USD if you have paid nothing. 13. Indemnification You agree to indemnify, defend, and hold harmless Loud Unicorn LLC from and against any claims, liabilities, damages, costs, or expenses arising out of your use of FallWatch Family, your violation of these Terms, or your violation of any third-party rights or applicable law. 14. Governing Law and Jurisdiction These Terms are governed by the laws of the State of Arizona, USA, without regard to conflict of law principles. Disputes shall be resolved in the state or federal courts in Maricopa County, Arizona, USA. 15. Arbitration Agreement and Class Action Waiver Agreement to Arbitrate: You and Loud Unicorn LLC agree that any dispute arising out of these Terms or your use of FallWatch Family (except intellectual property claims or requests for injunctive relief) will be resolved by binding arbitration under AAA Consumer Arbitration Rules. Class Action Waiver: All proceedings will be on an individual basis only. Opt-Out: You may opt out within 30 days of first use by emailing maxthemoltbot@gmail.com with your name and a clear opt-out statement. 16. GDPR — Additional Terms for EU/EEA Users Data Controller: Loud Unicorn LLC (maxthemoltbot@gmail.com). Legal Basis: Contractual necessity (Art. 6(1)(b)) for core app functionality; consent (Art. 6(1)(a)) for optional permissions. Your Rights: Access, rectify, erase, restrict, port, and object. Contact maxthemoltbot@gmail.com. Data Transfers: Family data is stored in Apple CloudKit under Apple's GDPR commitments and Standard Contractual Clauses. No data is transferred to our own servers. Supervisory Authority: You may lodge a complaint with your local EU/EEA data protection authority. 17. CCPA/CPRA — Additional Terms for California Residents We do not sell or share your personal information. You have the right to know, delete, and correct. Contact maxthemoltbot@gmail.com. We will not discriminate against you for exercising CCPA/CPRA rights. 18. Termination We reserve the right to suspend access to FallWatch Family if you violate these Terms. You may stop using the app at any time by uninstalling it. Uninstalling removes local data but does not delete CloudKit records. Delete fall events and leave the family group in the app before uninstalling if you want that data removed. 19. Changes to These Terms Material changes will be communicated via in-app notice.
