ACCEPTANCE OF TERMS By downloading, installing, or using the Veterinary Cremation Tracker mobile application (the "App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App. Your use of the App constitutes your acceptance of these terms in their entirety. 2. LICENSE GRANT We grant you a limited, personal, non-exclusive, non-transferable, and revocable license to use the App solely for your veterinary clinic's internal operational purposes. This license does not permit you to: sublicense, sell, lease, transfer, assign, or otherwise convey the App to any third party; use the App for any business purpose other than your own veterinary practice; or create derivative works based on the App. 3. PROHIBITED USES You agree not to use the App to: falsify, alter, or misrepresent chain of custody documentation, timestamps, or photo records; circumvent NFC or QR tag authentication mechanisms; access or use the App in a manner that violates applicable laws or regulations governing cremation services, pet remains, or professional licensing; use the App to process cremations for individuals or entities not authorized by your veterinary clinic; transmit false information to families regarding the status, handling, or return of pet remains; or use the App in any manner that could compromise the integrity of cremation tracking records or harm the reputation or operations of other users. 4. WARRANTY DISCLAIMER THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. 5. LIMITATION OF LIABILITY TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR USE, REGARDLESS OF THE CAUSE AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM. 6. CHANGES TO TERMS We reserve the right to modify these Terms of Use at any time. Continued use of the App following notice of changes constitutes your acceptance of the modified terms.
