Last updated: 2026-08-05 ESTATE SALE PRICING TOOL - TERMS OF USE By downloading, installing, or using the Estate Sale Pricing Tool app, you agree to these terms and conditions. If you do not agree, do not use the app. ACCEPTANCE OF TERMS These terms constitute a binding agreement between you and Loudunicorn LLC. Your use of the Estate Sale Pricing Tool indicates your acceptance of these terms in their entirety. If you use the app on behalf of a company, that company agrees to be bound by these terms and you represent that you have authority to bind it. LICENSE GRANT We grant you a limited, personal, non-transferable, non-exclusive license to download and use the Estate Sale Pricing Tool app on devices you own or control, solely for your professional pricing work in estate sales. You may not license, sell, transfer, assign, or share access to the app with others. You may not sublicense, rent, lease, or loan the app. Commercial licensing or multi-user access requires a separate agreement at higher pricing tiers. PROHIBITED USES You agree not to: reverse engineer, decompile, or attempt to derive the underlying methodology or data sources; use the app to price items for purposes other than estate sale valuation; submit false, misleading, or abusive item descriptions or photographs; use the app in violation of any applicable law; interfere with or disrupt the app's operation or servers; attempt to gain unauthorized access to the app, user accounts, or data; use the app to compete directly with Loudunicorn LLC; or share login credentials or access with unauthorized users. DISCLAIMER OF WARRANTIES THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT PRICING SUGGESTIONS ARE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR SPECIFIC ITEMS OR MARKET. PRICE ESTIMATES ARE BASED ON HISTORICAL DATA AND MAY NOT REFLECT CURRENT MARKET CONDITIONS, REGIONAL DIFFERENCES, OR ITEM CONDITION VARIATIONS. YOU ARE RESPONSIBLE FOR YOUR PRICING DECISIONS. WE MAKE NO WARRANTY REGARDING UNINTERRUPTED SERVICE, ABSENCE OF ERRORS, OR THAT THE APP WILL MEET YOUR NEEDS. LIMITATION OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOUDUNICORN LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR REVENUE, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE FEES YOU PAID IN THE TWELVE MONTHS PRIOR TO THE CLAIM. CHANGES TO TERMS We may revise these terms at any time by updating this document within the app. Continued use after changes constitutes acceptance.
