Terms of Service Last updated: July 25, 2026 1. ACCEPTANCE OF TERMS By downloading, installing, or using Local Facts ("App"), you agree to these Terms of Service ("Terms") and our Privacy Policy. These Terms form a binding legal agreement between you and Loud Unicorn LLC ("Developer," "we," "us," or "our"). If you do not agree, do not use the App. 2. LICENSE We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes, subject to these Terms. You may not copy, modify, reverse engineer, decompile, disassemble, sublicense, sell, or redistribute the App or any component of it. You may not attempt to extract our source code, circumvent security features, or gain unauthorized access to our servers or databases. 3. IN-APP PURCHASES AND PRO FEATURES 3.1 Pro is offered as an auto-renewing subscription that unlocks additional trivia categories, extended search radius, widget customization, and other premium features. Pro is available at $2.99 per month or $14.99 per year, or as a one-time Lifetime purchase at $29.99 that unlocks the same features permanently and does not renew. Prices may vary by region and are shown in the App before purchase. 3.2 All purchases are processed by Apple through the App Store. Payment is charged to your Apple ID account at confirmation of purchase. Your subscription renews automatically for the same term unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours before the end of the current period, at the price then in effect. You can manage or cancel your subscription at any time in your App Store account settings. If we offer a free trial, any unused portion of the trial is forfeited when you purchase a subscription. 3.3 Your Pro entitlement is active for as long as your subscription remains active and your Apple ID is authorized. If your subscription lapses or is cancelled, Pro features become unavailable once the current billing period ends. You may restore an active subscription using the "Restore Purchases" option in the App. 3.4 We reserve the right to modify, update, or remove Pro features at any time. We will make reasonable efforts to notify you of significant changes. All purchases are subject to Apple's payment terms and refund policies. Refund requests must be directed to Apple, and we do not process refunds directly. 4. CONTENT AND ACCURACY Trivia facts displayed in the App are sourced from publicly available information including historical records, government databases, and reference sources. They are provided for educational entertainment purposes only. We do not guarantee the accuracy, completeness, or timeliness of any content. LOCATION SERVICES The App requires location access to display nearby facts. By granting location permission, you acknowledge that your approximate GPS coordinates will be transmitted to our servers to retrieve relevant content. Location data is not stored. You may revoke location permission at any time in iOS Settings, which will limit App functionality. 6. PROHIBITED CONDUCT You agree not to: use the App for any unlawful purpose; harass, abuse, or harm others; attempt to reverse engineer or extract proprietary code; use automated tools to scrape or access our API beyond normal usage; interfere with the operation or availability of the App; impersonate any person or entity; or upload malicious code or content. 7. INTELLECTUAL PROPERTY All App content, code, design, graphics, and original material are owned by or licensed to Loud Unicorn LLC and protected under applicable intellectual property law. Nothing in these Terms transfers any ownership rights to you. 8. DISCLAIMER OF WARRANTIES THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS. 9. LIMITATION OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOUD UNICORN LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER. 10. INDEMNIFICATION You agree to indemnify and hold harmless Loud Unicorn LLC and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App in violation of these Terms or applicable law. 11. TERMINATION We may suspend or terminate your access to the App at any time, without notice, if we believe you have violated these Terms or if required by law. Upon termination, your license to use the App ends immediately. Sections 7, 8, 9, 10, and 12 survive termination. 12. GOVERNING LAW These Terms are governed by the laws of the United States. Any disputes shall be resolved through good-faith negotiation first. If unresolved within 30 days, disputes shall be submitted to binding arbitration or a court of competent jurisdiction. 13. APPLE-SPECIFIC TERMS These Terms are between you and Loud Unicorn LLC only, not Apple. Apple is not responsible for the App, its content, or any claims related to it. Apple has no obligation to provide maintenance or support for the App. In the event of a third-party intellectual property infringement claim, Apple is not responsible for investigation or defense. Apple is a third-party beneficiary of these Terms and may enforce them against you. 14. CHANGES TO THESE TERMS We may update these Terms at any time by posting the revised version in the App and updating the "Last updated" date. Your continued use after changes constitutes acceptance.
