If you do not agree to these terms, do not use the App. We reserve the right to modify these terms at any time. Your continued use of the App following changes constitutes acceptance of the modified terms. LICENSE GRANT We grant you a personal, non-exclusive, non-transferable license to use the App solely for your private, non-commercial enjoyment. This license does not permit you to reproduce, modify, create derivative works, distribute, sell, lease, transfer, assign, or otherwise exploit the App or any of its content. You may not sublicense, sell, rent, or lend the App to any third party. PROHIBITED USES You agree not to: Use the App for any commercial purpose or public display without authorization. Reverse engineer, decompile, or attempt to derive the source code, algorithms, or trade secrets underlying the App. Remove, obscure, or alter any proprietary notices, labels, or marks in the App. Interfere with or disrupt the functioning of the App or its servers. Attempt to gain unauthorized access to the App, user accounts, or associated systems. Violate any applicable laws, regulations, or third-party rights through your use of the App. Use the App in any way that could damage, disable, overburden, or impair our services. Transmit malware, viruses, or any harmful code through the App. DISCLAIMER OF WARRANTIES The App is provided on an "as-is" and "as-available" basis. We make no warranties, express or implied, regarding the App's functionality, accuracy, or fitness for a particular purpose. We do not guarantee that tide data will be accurate for all beaches, that sand physics simulations will behave exactly as real-world physics, or that the App will be error-free or uninterrupted. To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability and fitness for a particular purpose. LIMITATION OF LIABILITY To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including loss of data, profits, or business interruption, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount you paid for the App, if any. CHANGES TO THESE TERMS We may update these Terms of Use at any time by posting the revised version in the App and updating the "Last updated" date above.
