If you do not agree to all terms, do not use this app. We reserve the right to refuse service to anyone who violates these terms. LICENSE GRANT WakePhase grants you a limited, personal, non-exclusive, non-commercial, and non-transferable license to use this app solely for your own personal sleep tracking and alarm purposes. You may not sublicense, rent, lease, transfer, assign, or otherwise make the app available to third parties. You may not modify, translate, adapt, or create derivative works based on the app. PROHIBITED USES You agree not to: - Attempt to reverse-engineer, decompile, or disassemble the app or its source code - Use the app for any commercial or business purpose - Reproduce, copy, or distribute the app or any portion thereof without authorization - Use the app in any manner that could damage, disable, overburden, or impair our servers or networks - Attempt to gain unauthorized access to the app, user accounts, or connected systems - Use the app to transmit malware, viruses, or any code of destructive nature - Interfere with or disrupt the integrity or performance of the app DISCLAIMER OF WARRANTIES WAKEPHASE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE APP'S SLEEP PHASE DETECTION RELIES ON HEALTHKIT DATA ACCURACY; WE DO NOT GUARANTEE PRECISE SLEEP STAGE READINGS OR OPTIMAL WAKE TIMING FOR EVERY USER. LIMITATION OF LIABILITY TO THE FULLEST EXTENT PERMITTED BY LAW, WAKEPHASE AND ITS DEVELOPERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR PERSONAL INJURY, ARISING FROM YOUR USE OF OR INABILITY TO USE THIS APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE PAST TWELVE MONTHS. CHANGES TO TERMS We may update these Terms of Use at any time without notice.
